With the assistance of DEG, Rothwell Figg’s Client Roche triumphs over John Hopkins in rare 146 action.
On January 26, 2017, Chief Judge Leonhard P. Stark granted 454 Life Sciences (now part of Roche Molecular Diagnostics) complete victory in JHU’s appeal of an Interference decision that awarded priority to 454.  On de novo review of the PTAB’s decision, Judge Stark found that 454 was first to conceive and first to reduce to practice the invention in dispute.
